Nous avons été consternés d'apprendre la récente nouvelle concernant l'arrêt de la Cour de cassation de la Turquie confirmant la peine d’emprisonnement contre le député de HDP et le défenseur des droits de l'homme, M. Ömer Faruk Gergerlioğlu. Cette décision concerne une condamnation à 30 mois d’emprisonnement en raison de la "diffusion de propagande terroriste". À l'évidence, ce jugement constitue une nouvelle ingérence arbitraire dans son droit à la liberté d'expression et une violation des principes de procès équitable et de l’immunité parlementaire.

We are appalled to hear the recent news concerning the judgment of the Turkish Court of Cassation upholding the prison sentence against Member of Parliament (HDP) and human rights defender Mr. Ömer Faruk Gergerlioğlu. The ruling concerns an imposition of 30 months imprisonment sentence on account of “disseminating terrorist propaganda”. It is obvious that this judgment constitutes yet another arbitrary interference with his right to freedom of expression and a breach of fair trial principles and parliamentary immunities.

HDP Kocaeli Milletvekili ve insan hakları savunucusu Sayın Ömer Faruk Gergerlioğlu hakkındaki hapis cezasının Yargıtay tarafından onanması karşısında şoke olduk. Sözkonusu karar, ‘terör örgütü propagandası yapma’ suçu sebebiyle 2 yıl 6 ay hapis cezası verilmesini hukuka uygun bulmuştur. Bu hükmün Sayın Gergerlioğlu’nun ifade özgürlüğüne keyfi bir müdahale oluşturduğu ve adil yargılanma ilkeleri ile yasama dokunulmazlıklarını ihlal ettiği açıktır.

Upon the news that appeared in the press concerning the torture suffered by our former colleagues under detention on 26 May last year, the Ankara Bar Association issued a report through interviewing the victims and documented that at least 5 former Turkish diplomats were tortured by the police. Likewise, Ömer Faruk Gergerlioğlu, human rights defender and MP of the Peoples’ Democratic Party (HDP), stated in his press statements and interviews that “the detained former diplomats were severely beaten, tortured and threatened with rape with batons whilst under police custody”.
